Gauhati HC directs Nagaland chief engineer to verify, submit report on road construction within two weeks

The Gauhati High Court has recently directed the the Chief Engineer, Roads and Bridges, Government of Nagaland, to conduct a spot verification and submit a report within a period of two weeks as to whether the Wokha-Merapani road has been constructed and completed as per the Schedule-B of the contract agreement or not.

The Kohima Bench comprised of Justice Songkhupchung Serto and Justice S. Hukato Swu heard a PIL whose subject matter is a work of rehabilitation and upgradation of Wokha-Merapani Road Project from Wokha Junction (0/000km) to (60/585 km) in 3 (three) packages in Assam and Nagaland on EPC (Engineering, Procurement and Construction) mode.

Petitioner’s advocate Senior Counsel Taka Masa apprised the Court that according to instruction received from the petitioners, construction of the road at some portions is not exactly as given in Schedule-B of the contract. Therefore, an independent person or authority may be directed to make an on-the-spot verification.

In view of the claims and counter-claims of the parties, the Court directed  the Chief Engineer, Roads and Bridges, Government of Nagaland, to conduct a spot verification and submit a report as to whether the Wokha-Merapani road has been constructed and completed as per the Schedule-B of the contract agreement or not.

“He shall do the same within a period of two weeks. All the stakeholders shall be present at the spot when the verification is conducted by the Chief Engineer. List it again after on December 8,” the order reads.
