Gauhati High Court disposes PIL alleging corrupt practices in implementation of PMAYG

The Gauhati High Court recently disposed of a Public Interest Litigation (PIL) filed alleging that corrupt practices have been made in the matter of implementation of the Pradhan Mantri Awaas Yojana Gramin (PMAYG) for the years 2017, 2018 and 2019 in Narainpur-Gupkhana Gaon Panchayat in the district of Hailakandi, Assam.

The PIL filed by one Babul Ahmed Sodiol alleged that acting on a complaint petition filed by the petitioner with regard to the corrupt practices, the Deputy Commissioner, Hailakandi had directed the Block Development Officer, Hailakandi, and the Circle Officer, Hailakandi, to conduct an enquiry in the matter and to furnish a detailed report. However, no enquiry was conducted in the matter by the Block Development Officer and the Circle Officer and, being aggrieved, the present PIL has been filed by the petitioner.

The State respondents have filed affidavit stating that in compliance of the direction of the Deputy Commissioner, Hailakandi, a detail enquiry was conducted on the allegations of corrupt practices and the Block Development Officer, Hailakandi, also submitted a detailed report vide letter dated 17.03.2022, to the Deputy Commissioner, Hailakandi.

It is also contended that in the enquiry it was revealed that there was no corrupt practice in the selection of the beneficiaries under the PMAYG scheme, as alleged by the petitioner.

In view of the categorical statement made by the State respondents that a detailed enquiry has already been conducted on the allegations of corrupt practices and it was found that there was no corrupt practices in implementing the PMAYG scheme, as alleged by the petitioner, the Division Bench of Chief Justice (Acting) N. Kotiswar Singh and Justice Soumitra Saikia is of the view that the matter does not require any further monitoring by the Court.
