Gauhati High Court closes PIL questioning the set up of underground railway bridge

The Gauhati High Court closed a Public Interest Litigation (PIL) filed questioning  as to why a Railway level crossing/Railway underground bridge at village NorthSalmara Pt-II (Ujanpara) on the existing village road shall not be set up . 
The PIL filed  prayed for the following reliefs: 

-to admit this application, call for the records and issue a Rule calling upon the Respondents to show cause as to why aRailway level crossing/Railway underground bridge at village NorthSalmara Pt-II (Ujanpara) on the existing village road shall not be set up asper the minutes of the meeting dated 16.02.2012  and after return of the Rule and upon such cause or causes beenshown and upon hearing the parties be pleased to make the rule absolute giving full and complete relief to the Petitioners and/or pass such order or orders as Your Lordship may deem fit and proper.-

                                                                                                                        AND
Pending disposal of the Rule, be pleased to direct the Respondent authorities not to close/obstruct the existing village road of North Salmara Pt-II(Ujanpara) and/or pass any other appropriate order.

The Division Bench of Chief Justice R. M. Chhaya and Justice Soumitra Saikia  noted  that in response to the notice issued by the High Court, the respondent authorities have filed affidavits.

Ultimately R.K. Borah, learned Additional Senior Government Advocate, Assam, has produced on record a communication dated23.09.2022 along with photocopies of the Preliminary Notification published in the dailynewspapers, namely, ‘The Assam Tribune’ (English) and ‘Niyomiya Barta’ (vernacular) on23.09.2022. The same is taken on record.

In view of the aforesaid development which is brought on record, the relief prayed for in this petition substantially gets answered. The State as well as the Railway authorities shall complete the acquisition and carry out the project as expeditiously as possible , observed the High Court while closing the PIL.
