Chief Justice Dipak Misra on Tuesday (August 7) cited the Supreme Court’s landmark judgments on euthanasia and privacy, both delivered under his leadership, as some of the milestones in the Indian judiciary’s march towards globalisation. The CJI was delivering the first annual A P J Abdul Kalam lecture on the ‘Role of judiciary in the era of globalization’ organised by industry body Assocham in New Delhi.

He said that developing countries must seize the benefits of globalization in order to strengthen and modernize their democratic institutions and public administration. He said the Indian judiciary has benefited well in borrowing from international judicial approaches.

He said that this approach must be welcome and embraced by business enterprises as well and said that for multinationals it wasn’t only their duty towards their parent organisations but a duty towards the host nation that should be important.

Judicial approaches of different nations have remained diverse, and hence the CJIs’ suggestion that excellent judicial deliverances should be taken into account from any part of the world is crucial. He said: “The legal systems of various countries and the judiciary in particular have to respond affirmatively to this irresistible phenomenon of globalization. The approach must be to inculcate the best practices of various nation states by enriching the judicial arm from the experiences of others so as to make the institution of judiciary more robust than ever.”
