The Anjuman Intezamia Masjid Committee, which is monitoring the Gyanvapi mosque case, has challenged the Varanasi court order rejecting their petition against allowing Hindu women permission for regular worship inside the Gyanvapi complex.
The Allahabad High Court will hear the plea next week.
On September 12, a district court in Varanasi rejected the mosque committee’s plea challenging Hindu worshippers’ request for permission for daily worship of Hindu deities in the Gyanvapi mosque.
District Judge AK Vishvesha, delivering the verdict in the Gyanvapi Shrinagar Gauri dispute, said the case is maintainable.
Rejecting the mosque committee plea, the court had said that the suit by Hindu parties is maintainable. The matter will be heard in the High Court on October 18.
The Varanasi District Court had dismissed its plea against the civil suits that sought right to worship Maa Shringar Gauri and other deities within the mosque premises.
The preliminary ruling by the District Judge had meant that the case would now be heard on merits where the parties present evidence to prove their claims.
Rakhi Singh and other Hindu women had moved the Varanasi court demanding regular worship of the deities on the outer part of the disputed mosque.
To this, the Muslim side said that the plea is not maintainable under Order 7 Rule 11 of the Code of Civil Procedure and it should be dismissed. The district judge had rejected the objection raised by the Muslim side.
On the orders of the Supreme Court, the hearing of the case had shifted to the Varanasi District Judge.
After months of hearing, the district court reserved its order in August and allowed Rakhi Singh case to continue.
The mosque committee again filed the petition and reiterated that the matter cannot be heard under the Places of Worship Act of 1991.
In the plea, there has also been a demand for a stay on the ongoing hearing in the Varanasi court till the High Court’s decision. Five cases related to Gyanvapi dispute are already pending in the Allahabad High Court.
