The practice of the Supreme Court registry of deleting matters posted for any particular day was condemned by the Supreme Court judge Justice M. R Shah on Thursday.
Justice Shah while addressing the court -master asked as to “Who is he (the Registrar) to decide? Mr Shah said it is none of registry’s business and the authority lies with the court , which would decide.
Talking about the registry he said that registry has a set reply’Zyada matters hain toh delete kar dete hain’ meaning there are lot of matters so we delete.
Showing his displeasure ,Justice Shah said nahi chalega! (They say, ‘There are excess matters so we will delete it’? That is not how it works!)…Who is he to decide it is an excess matter? I am the master.
Senior Advocate Arvind Datar, who was appearing before the bench, comprising Justice B. V. Nagarathna, Justice Shah remarked, who are registry to say excess matters are there, so delete it’. And we don’t know when it will come!”
To the court-master, Justice Shah said, “Tell him (the Registrar), ‘Hum specifically bunching karke rakhte hain so aisa nahi karna chahiye’ (Tell him, ‘We specifically do the bunching of the matters and post them, so this should not be done’
