Karnataka HC Allows Physical Filing Of New Cases For Three Days On trial Basis

The High Court of Karnataka on Saturday has decided to commence the physical filing of new cases at Dharwad and Kalaburagi benches commencing from 20th May, 2020, on trial basis for three days only in between 11 AM and 1 PM.

During these three days, the physical filing of new cases, filing of caveat petitions, and statement of objections, vakalathnama and interim applications in pending matters will be permitted. The advocates will be required to take a prior appointment for such physical filing to be done on these three days. The arrangement is being made on the trial basis and the same is liable to be cancelled in the event it is found that the guidelines aren’t being followed.

The notification has issued the proper procedure that needs to be followed by the Advocates, the parties-in-person or the Advocates’ clerks who wish to file the matters on these dates:

  • They need to apply for seeking appointment of the date and time for physical filing of the matters.
  • They need to specify the matters to be filed by them in the respective Benches. The applications will have to be made on the notified email ids.
  • The date, time and counter number will be communicated to them by sending a reply for filing of the matters on the same e-mail ID from which requests are received.
  • A printed copy of e-mail received fixing the date of appointment or a soft copy will have to be shown to the security personnel. The entry will be given to the High Court precincts at both the Benches in the specified area in basement floor, only after the soft copy is shown.
  • They will be required to reach the High Court precincts ten minutes before the scheduled time of appointment.
  • They will have to undergo medical screening and only those who are found asymptomatic will be allowed entry, and will have to stand in queue in the specified area in the basement floor.
  • Social distancing will have to be maintained while standing in the queue and no person will be allowed to enter in the High Court precincts without wearing a mask.
  • The High Court will also create a separate Counter in the same venue for serving the advance copy to the office of the Advocate General and State Public Prosecutor and Oath Commissioners will be available in the parking lot.On the presentation form in duplicate Advocates will have to mention their correct e-mail address and cell phone number.
  • Only 5 matters can be filed at a time by the Advocates.

Once the filing is accepted, the acknowledgement will be issued on the office copy of presentation form filed in duplicate. All the steps that will be required to be undertaken for rectification of objection etc will be communicated at the e-mail address or the cell phone number mentioned on the presentation form and will also be uploaded on the official website of the High Court.

The matters which require urgent hearing will be filed by moving a memo for fixing the dates by following the procedure set out by the April 30, notification of the Principal Bench of the High Court, already published in the official website of the High Court.

After filing is completed, Advocates, parties-in- person and the Advocates’ clerks will have to immediately leave the Court precincts and will not be allowed to enter the Court building.
