Lawyer writes to AG Venugopal, seeks his nod for initiating criminal contempt proceedings against Chandrashekhar Azad for disgracing judiciary

A Delhi-based lawyer has written to Attorney General K. K.Venugopal, seeking permission for proceeding with criminal contempt of court proceedings x,śx against Chandrashekhar Azad ‘Rawan,’ President of Bheem Army and Leader of Azad Samaj Party for scandalising the Indian Judiciary and disgracing its dignity.

Advocate Vineet Jindal referred to the recent interview of the Chief of Bheem Army, which was aired on a news channel on August 27, 2021 and also widely circulated on internet, in which Mr Azad passed derogatory and scandalous statements about the Supreme Court of India and its judges.

In his interviewed video of 8.27 minutes, the Bheem Army chief passed derogatory remarks against the Supreme Court Collegium system.

“Samvidhaan me koi pravadhan nahi hai is tarike ka, ye to yahan ke logo ne bana diya jo judge baithe hue hai collegium, collegium kaise tay kardega, judge ka beta judge, judge ka bhatija judge, judge ka damaad judge, judge ka bhai judge, ye kya baat hui, dalito mein, pitchdo mein, muslimo mein pratibha nahi hai (There is no such provision in the Constitution. The Collegium has been created by the Judges. How can the Collegium decide who will become a Judge? The son of a Judge will become Judge, his nephew, son-in-law, brother, all will become Judge. How’s that possible? Dalits, SC/ST/OBCs, Muslims don’t have talent),” the letter stated.

Mr Jindal averred that Mr Azad has scandalised the process of selection of judges on the basis of the Collegium. As per his statement, the selection is done solely on the basis of personal relations or family relations of the selected judges with the sitting judges. Thereby Chief of Bheem Army has alleged that the selection process as totally biased and that it takes place in the interest of sitting judges and their family members.

Mr Azad made further comments against the Judiciary. He said,

“Kisi ne 50 crore ka ghotala kiya, aur vo apni setting se 2 crore kissi samanit vyakti se transfer karwa de to 48 crore nagad bach gaye, order aa jata hai uske favour mein, janta dekh rahi hai, mujhe ye kehne mein koi dikkat nahi hai ki bada ghotala vahan se ho raha hai, sabki janch honi chahiye, Supreme Court ke jitne judge hai unki janch honi chahiye unki sampatti ki itni sampaati kahan se aayi aur uska kya source hai, tankha se alag konsa business kar rahe hai ki itni sampatti aaa gayi hai.”

Advocate Jindal alleged that Azad, by stating the above statements, has directly made with intent to disgrace and scandalise the sitting judges of the highest Court the Supreme Court of our country.

The statements by Azad have scandalised the judgments passed by the Supreme Court judges and accused them of being corrupt. “If this kind of precedents were allowed, political leaders would start making reckless allegations against the judges of the highest Court of our country and this trend would soon lead to the failure of an independent judiciary system,” said Mr Jindal.

It is highlighted that Chandrashekhar, through the statement, has dishonored the Honorable Judges of the Supreme Court who are the guardians of the whole legal system and disgraced and jeopardized the integrity of the entire judicial system . This kind of statement would affect the masses by a growing sense of mistrust and concern among public about the fall in the standards of the judicial system, he added.

“I am therefore seeking your kind consent under section 15 (1) (b) of the contempt of courts Act 1971 , read with rule 3 of the rules to regulate the proceedings for the contempt of the Supreme court 1975 to initiate criminal contempt against ChandarShekhar Azad “Ravan””, the letter reads.
