The Rajasthan High Court, while dismissing a petition of a Live-in relationship couple, has observed that live-in-relationship between a married and an unmarried person is not permissible.
A Single Bench of Justice Pankaj Bhandari was on June 7 hearing a plea by a couple, who sought protection of life and liberty.
The Court, while perusal of the record, noted that Petitioner No. 2 ( Boy ) was already married.
“The pre-requities for a live-in-relationship as held by the Apex Court in “D Velusamy vs D Patchaiammal (2010) 10 SCC 469” is that the couple must hold themselves out to society as being akin to spouses and must be of legal age to marry or qualified to enter into a legal marriage, including being unmarried. Criminal Miscellaneous Petition is accordingly dismissed,” the order read.
Earlier, the Rajasthan High Court in another case had directed police protection to be provided to a couple in a live-in relationship. The Court directed the police to ensure petitioners’ safety and reiterated their duty towards protection of rights enshrined under the Constitution.
