New Delhi (ILNS): The Punjab and Haryana High Court has rejected the anticipatory bail plea of the accused filed to avoid arrest in the case of determining the sex of the foetus in the womb, and said that it is a serious offense.
The bench of Justice Avnish Jhingan said in the judgment that the Constitution has given the right to equality on the basis of gender, but the right to equality of female foeticide by examining the sex of the unborn child is ignored.
The accused, Hassan Mohammad, was booked by the Haryana Police under Sections 353 (Assault or criminal force to deter public servant from discharge of his duty), 186 (Obstructing public servant in discharge of public functions), 420 (cheating) of IPC and Sections 4, 5, 6, 23 and 29 of the Pre-conception and Pre-natal Diagnostic Techniques (Prohibition of Sex Selection) Act, 1994, on September 29, 2020.
Accused Hasan Mohammed has also cheated many people in the name of ultrasound. He is not entitled to get anticipatory bail.
The High Court said in the judgment that it is no hidden desire in the society to have a son. In such a situation, female foeticide is a curse that was enacted to stop it.

The bench said that if female foeticide is not strictly stopped in time, it will have terrible consequences. In many parts of the country, the sex of the fetus in the womb is being examined. If this practice continues, it will create an imbalance in society. When a girl is found in the womb, she is being killed, which is playing with the future of the country.
