Orissa HC Stayed Transfer of CRPF Personnel From Bhubaneshwar To Kathgodam

A single Judge of Orissa High Court stayed the transfer of the petitioner till disposal of his representation by Director General of Police, CRPF, New Delhi.

Justice K.R. Mohapatra after hearing the Writ Petition of the petitioner directed him to submits a detailed representation before the Director General of Police, CRPF, New Delhi ventilating his difficulty and developments within a period of seven days, hence  DGP, CRPF, New Delhi shall do well to consider the same on its own merit as expeditiously as possible preferably within a period of four weeks therefrom.  

The petitioner challenged his transfer from Group Centre, CRPF, Bhubaneswar to 243 Battalion of CRPF, Kathgodam in the State of Uttarakhand.

The petitioner counsel Mr. S.S. Mohapatra contended that he has already worked at hard places including Jammu and Kashmir and Arunachal Pradesh and he was transferred to Bhubaneswar during July, 2016. Due to his personal difficulty, he had sought for voluntary retirement, which has already been accepted vide order dated 07.07.2020 and he is retiring on 31.12.2020, so allow him to continue at Bhubaneswar.

Mr. A. K. Bose Asst. Solicitor General for the Union of India submits that transfer has been made following the norms and guidelines of the Central Reserve Police Force. According to the guidelines, if a personnel is posted at static places, normal transfer is made within a period of three years of his posting and if the personnel is posted at hard places, ordinarily transfer is made within a period of four years. Since the petitioner is at present posted at a static place and he is being transferred to another static place, there is no difficulty on the part of the petitioner to join at his place of transfer.
