The All School Parents Association has requested Uttar Pradesh Chief Minister Yogi Adityanath, in a letter, that before the appeals of schools are heard against the fees set by the district fee authority, the schools should deposit at least 75% of the amount in the revenue department like in District Rural Development Agencies (DRDA).
Association President Shivani Jain, Legal Advisor Fujail Khan and National General Secretary Sachin Soni told journalists that due to the appeal passed by the District Duty Regulatory Committee to the Appellate Authority / Court, parents are not getting the benefit of the Fee Determination Act.
They shared the letter they sent to Chief Minister Yogi Adityanath with journalists. The letter says the present Yogi Adityanath-led government has provided relief to parents by making fee fixation laws to prevent arbitrary fee hikes by private schools. The order of the District Fee Regulatory Committee constituted as per law can be appealed to the Appellate Authority.
But schools, which have appealed the order passed by the District Fee Regulatory Committee, to the Appellate Authority / Validate Court have clearly refused to accept the fees prescribed by the Committee. The District Fee Regulatory Committee has avoided any action against them because only the order of the committee has been challenged by schools in the authority / recognized court.
Due to this, parents are not getting the benefit of the law made by the government in public interest. In the letter to the Chief Minister, it has been requested that upon submission of at least 75% of the amount by the schools, while amending the Self-Financed Independent Schools (Fee Regulations) Act 2018 on the lines of Section 19,20 and 21 of the Recovery and Bankruptcy Act 1993, the appellate authority / valid court should be given the right of hearing.
