The Rajasthan High Court on Tuesday has stayed the proceedings of FIR registered against Jagat Prakash Nadda, the President of BJP in connection with the tweets made by BJP leader Amit Malviya against Rahul Gandhi.
The matter relates to a tweet made by Amit Malviya in response to a statement made by Sonia Gandhi at a Video Conference wherein she said that “It is because Rahul Gandhi had issued a warning about coronavirus in February itself that states like Rajasthan got into action fast. They ensured there were enough PPE (personal protective equipment) kits.”
Thereafter Amit Malviya responding to Sonia Gandhi in a tweet said “Sonia Gandhi claims Bhilwara tested 22 lakh people due to Rahul’s warning! Wherever there is Rahul, can exaggeration and maths blunder be behind?”
The petitioner’s counsel said that the FIR relates to a tweet made Amit Malviya whereas the present petitioner has no role and he has been simply alleged to be controlling the office of Amit Malviya.
He further submitted that the tweet was made from the private account of Amit Malviya and not from the official handle of the organization being headed by Mr. J.P. Nadda.
The single judge bench of Justice Pushpendra Singh Bhati stayed the proceedings of FIR and observed that the tweet had been made by Amit Malviya and the present petitioner i.e. Shri J. P. Nadda had no role in tweeting the information in question. The tweet being apparently from the private tweeting handle of Amit Malviya, the present petitioner had no role at this stage.
