The Supreme Court will decide the 49-year-old property dispute worth over Rs 2,600 crore of the last Nawab of Rampur, Raza Ali Khan.
For the distribution of this property, Rampur’s district court has sent a ‘Partition Scheme’ to the Supreme Court. Under this scheme sent by the lower court on December 6, it has been decided to distribute the property of Nawab Raza Ali Khan among the 16 heirs under Sharia law. Now, the Apex Court will have to take a final decision on this.
Earlier on July 30, 2019, the Supreme Court had ordered the Rampur court to take a decision on the division of property under Sharia law. Prior to the order of the Supreme Court, the lower court and the Allahabad High Court had ruled in favour of the heirs of Murtaza Ali Khan, the eldest son of Nawab Raza Ali Khan, in the property division dispute.
It was alleged that Murtaza Ali Khan’s heirs had taken possession of movable property including five immovable properties of Nawab Raza Ali Khan and his family.
There are two sides regarding the property of Nawab Raza Ali Khan, the last ruler of Rampur. Mohammad Ali Khan, the son of the late Nawab Murtaza Ali Khan, and daughter Nighat Ali Khan, eldest son of late Nawab Raza Ali are on one side. On the other, the heirs of Nawab Raza Ali Khan’s two other sons, Late Nawab Zulfiqar Ali Khan and Late Nawab Abid Ali Khan, and those of their six sisters.
In this case, Talat Fatima, daughter of Nawab Raza Ali Khan’s eldest daughter, filed a petition in 1972. In which there was a demand to distribute the property among all the heirs on the basis of Sharia law under the Muslim Personal Law Board.
