The Supreme Court has, expectedly, overturned the shocking Chandigarh court order banning abortion in a case where a ten-year-old girl got pregnant through repeated rapes by her uncle. The subordinate court had refused her to undergo an MTP citing that law allows only MTPs under 20 weeks. She is 26-weeks pregnant.
On Monday (July 24), the apex court bench of Chief Justice JS Khehar and Justice DY Chandrachud issued notice to the government to allow the girl to undergo MTP.
Responding to the plea for MTP, the bench ordered a medical board to look into the possible risk on the girl’s life due to the abortion. The bench asked the member secretary of Chandigarh Legal Services Authority to assist it as an amicus and get her examined by a board of doctors on July 26.
