Sonu Sood vs BMC: Actor withdraws his plea in Supreme Court

Bollywood actor Sonu Sood has withdrawn his plea to the Supreme Court wherein he had challenged the Bombay High Court order which had dismissed his plea against a notice issued by the Brihanmumbai Municipal Corporation over alleged illegal construction at his residential building in Mumbai’s Juhu. 

During the hearing on Friday, Senior Counsel Mukul Rohatgi, appearing for Sood, submitted he has filed an application for regularisation pursuant to the notice dated 24.10.2020 under Section 44 of the Maharashtra Regulation and Town Planning Act, 1966. Therefore, he has prayed to withdraw the present petition as well as the civil Suit No.1368 of 2020 pending before Bombay City Civil Court at Borivili Division, Dindoshi, Bombay.

A three-judge bench of Chief Justice S.A. Bobde, Justice A.S. Bopanna and Justice V. Ramasubramanian has directed the concerned Authorities to consider and decide the said application on its own merits and in accordance with law.

“Accordingly, the special leave petition and the civil suit being L.C. Suit No.1368 of 2020 are dismissed as withdrawn,” noted the Court in its order.

The Bombay High Court had dismissed his appeal against the BMC notice. Sood had approached the high court challenging an order of a city court that had dismissed his suit against the BMC notice on the alleged illegal construction carried out by him.

Sood stated in his petition that he is neither a criminal nor has he made any external changes against the law and the rules. He said he had changed the interiors of the hotel. 

BMC’s bye-laws say interior decoration does not require any clearance. However, the application for permission was filed in 2018. Till now, the BMC has not taken any decision on that application.

The Bollywood actor in the interim application in High Court had sought an order from the court restraining the BMC from taking any coercive action against his residential property.

The BMC said Sood had carried out structural changes in the six-storey residential building Shakti Sagar, and converted it into a hotel without requisite permission.

The BMC has also filed a complaint at the Juhu police station, seeking an FIR to be lodged against Sood for allegedly converting the residential building into a hotel without permission.
