The Supreme Court on Monday agreed to hear a petition in July, challenging the 2019 notification that scrapped the special status of Jammu and Kashmir under Article 370 of the Indian Constitution.
The matter was mentioned before a two-Judge Bench of the Apex Court, headed by Chief Justice N.V. Ramana, and also comprising Justice Hima Kohli.
“This is the Article 370 matter… the delimitation is also going on,” requested Advocate Shekhar Naphade.
Justice Ramana, who completed one year as CJI yesterday, said
“Let me see as this will be a five-Judge matter and the Bench will have to be reconstituted.”
In 2019, a petition was referred before a Bench of Justice NV Ramana, Justice Surya Kant, Justice Sanjay Kishan Kaul, Justice BR Gavai and Justice R Subhash Reddy.
Justice Subhash Reddy retired this year in January so there needs to be an addition to the bench to complete it.
CJI Ramana understands the importance of the matter and thus referred for the complete bench
