The Supreme Court has quashed the charges of cruelty filed by a wife against her husband after a settlement between them.
A divisional bench comprising Chief Justice S.A. Bobde and Justice R. Banumathi while hearing the matter through video conferencing stated that, “Since the husband and wife have amicably settled the matter, considering the fact that the appellant is a distant relative of the husband and wife”, hence, quashed the FIR filed against the husband.
The FIR filed against the husband was under section 498A (Husband or relative of husband of a woman subjecting her to cruelty), 506 (Criminal Intimidation), 323 (Punishment for voluntarily causing hurt), and 406 (Punishment for criminal breach of trust) read with section 34 (Common Intention) of the Indian Penal Code
Counsel appearing for the appellant Mr. Atul Babasaheb Dakh submitted before the court that the wife and the husband have already compromised the matter.
Whereas, Mr. Rahul Chitnis appearing for the state submitted that he also has instruction to state that the husband has amicably compromised the matter with his wife. He further added that the State has no objection for quashing the aforesaid FIR registered against the present appellant.
