New Delhi (ILNS): The Supreme Court has stayed the Jharkhand High Court’s decision of September 21, 2020, repealing the Jharkhand government’s planning policy and prohibiting the teacher reinstatement process.
The recent development has come as a big relief to the Hemant Soren government of Jharkhand and about 18,000 teachers. After this decision, a large number of teachers reached the Mohababadi Ground in Ranchi and celebrated by distributing sweets.
Earlier, on a petition challenging the planning policy enacted and implemented by the Jharkhand government, the Jharkhand High Court had cancelled the appointment process of 18,000 teachers while passing the judgment. The High Court order was affecting the appointment of 3,684 high school teachers appointed in 13 scheduled districts of the state.
While hearing a special leave petition, a bench of Justices Ashok Bhushan, R. Subhash Reddy and M. R. Shah, stayed the order of the Jharkhand High Court. The matter is further listed for hearing on November 4, 2020. In this regard, notices have been issued to all the parties asking them to file their reply before November 4.
The Supreme Court has said in its order that all the teachers working in the 13 districts of the schedule area will continue to work till the final hearing of this case is done. The High Court’s decision will not affect their service right now. The bench said that the case needs to be heard soon and this is the reason the court has given 15 days time to all the parties.
After the planning policy was formed in the year 2016, the process of appointing 17,572 teachers in high schools is going on for four years. In 2016, the Jharkhand Staff Selection Commission (JPSC) had advertised for the appointment. In this advertisement, 24 districts were divided into two categories (13 districts scheduled districts and 11 districts non-scheduled). The posts of scheduled districts were reserved for the local people of the same district.
At the same time, in the non-scheduled district, external candidates were also allowed to apply. Applications were made for the appointment of teachers for a total of 8,423 posts in scheduled districts. Out of these, about 3,684 teachers had been appointed. These teachers are currently teaching in different schools. At the same time, in non-scheduled districts, applications were taken for appointment to 9149 posts. They were tested at the end of the year 2017. The result was released in the year 2019. This year, teachers got appointment letters.
After publication of the result, the commission recommended the appointment of 8,371 candidates. Based on this recommendation, 8,082 teachers are currently teaching in different districts. Except for a few districts, the recruitment process was not completed in all subjects in most of the districts. In the history and Sanskrit subjects, the posts of teachers were left vacant in most districts. The teachers of these subjects are still not appointed.
