Supreme Court to hear force majeure case

ILNS: The Supreme Court will on Tuesday hear a plea filed by Health Care Medical Device Pvt. Ltd. against the March 16 order of the High Court of Madhya Pradesh, whereby the high court dismissed their petition against the order of January 22, 2021 in which the company was blacklisted for two years. The company was debarred from participating in future tenders for two years and the security deposit of the petitioner company was forfeited.

The submission of the petitioner company is that it participated in the tender issued by Madhya Pradesh Public Health Service Corporation Limited for the supply of Covid 19 gloves to various government hospitals in MP. And the tender submitted by the petitioner was lowest and its bid was accepted.

Thereafter, the petitioner supplied 65% of the goods but could not supply remaining goods on time on account of force majeure i.e. its plant broke down as well as because of the imposition of night curfew at the place of manufacture.

This will be an interesting case to watch.
