Swami Chinmayanand gets anticipatory bail in rape case

The interim anticipatory bail granted to former Union Minister, Swami Chinmayanand was finally confirmed by the Allahabad High Court in a case where he was accused of raping a woman from Shahjahanpur, Uttar Pradesh in 2011.

The interim order was confirmed after Justice Dinesh Kumar Singh confirmed after the complainant, on affidavit, stated that she was not interested in pursuing the case and that she had no objection to withdrawing the criminal prosecution against Chinmayanand.

The State also said that it has asked to withdraw from prosecution and that permission had been granted to the Public Prosecutor to file an application under Section 321 (withdrawal from prosecution) of the Code of Criminal Procedure (CrPC).

A per the Court state as well as the complainant have any objection to the grant of anticipatory bail to the Chinmayanand.

The Court said that while considering the stand of the complainant and the State, this Court finds it ok to grant bail to the accused.

The Court has however asked Chinmayanand for appearing before the trial court within a week and also for submitting a personal bond along with two sureties each of the like amount if he had not already done so in pursuance of the interim order.

The reason for Chinmayanand been booked was that a woman who had spent 11 years at his ashram accused him of committing rape against her.

The woman in her complaint mentioned that she was given intoxicants in her food, after which she was made physical relations with. Chinmayanand has been alleged to brutally ravished her.

As per the complainant earlier, Chinmayanand was also accused of taking obscene audio-visual videos and pornographic photographs.

Complainant has mentioned that in he process, she was impregnated twice. where underwent abortion, once in Bareilly and once in Lucknow.

Chinmayanand was represented by Senior Advocate Anoop Trivedi along with advocates CP Pandey and Abhinav Gaur.
