Supreme Court Collegium entertains transfer of two High Court judges on personal reasons

The  transfer requests of two High Court judges – Justice Sanjeev Prakash Sharma of the Patna High Court and Justice Atul Sreedharan of the Madhya Pradesh High Court has been allowed by the Supreme Court Collegium.

The Collegium in its resolutions passed in a meeting stated that Justice Sharma, whose parent High Court is the Rajasthan High Court, informally sought to be repatriated owing to health grounds.

Justice Prakash who is currently posted as Judge in Patna High Court has cited the inadequate medical facilities in city as the reason for transfer.

Justice Prakash had sought a transfer to the Punjab & Haryana High Court, as Chandigarh has the necessary medical facilities in case he cannot be given his parent High Court.

The Collegium has allowed for the Punjab and Haryana High Court.

The Collegium in its recommendations said that it is not possible to repatriate Mr Justice Sanjeev Prakash Sharma to his parent High Court. Bearing in mind the health reasons which have led the Judge to seek a transfer out of the High Court where he is posted at present, the Collegium resolves that Shri Justice Sanjeev Prakash Sharma be transferred, to the High Court of Punjab and Haryana.”

The other judge who asked for a transfer was Justice Sreedharan, who is currently a judge at the Madhya Pradesh High Court. He wrote to the Collegium seeking a transfer out of the State, as his daughter is soon entering law practice there.

The Collegium recommended him to be transferred to the High Court of Jammu & Kashmir and Ladakh, in the interest of better administration of justice.
