Keeping in mind the exigencies in disposal of batch of criminal appeals, the bench of Justice Sanjay Kishan Kaul and Justice Hrishikesh Roy asked the AAG Garima Prasad of Uttar Pradesh that state government does not require any court orders pertaining to release of convicts.
It is contended that the staff and bouncers working of Hotel Allahabad Regency, Civil Lines, Prayagraj, have let loose a reign of terror upon residents of the neighbourhood. The petition has demanded that the local people be provided security from the hotel staff.
The Court held that the State Government also stepped in and did its effort in bringing out a Government order dated January 04, 2018, for controlling the blatant misuse of loudspeakers. The said Public Interest Litigation is still pending before the Court.
The Bench held, “Petitioner no 1 (woman) has mentioned in the petition that she is the legally wedded wife of respondents and she has, for whatever reasons, decided to go away from her husband. Can we permit them to live-in under the guise of protection of life and liberty?
It is further clarified that the fact of the petitioner having converted to Islam would not be a relevant factor while ensuring that there is no interference in the liberty of the petitioners unless there is any allegation by petitioner no.1 regarding forcible conversion.
The Court directed the State Election Commission to “produce before us the CCTV footage of the designated counting areas and centres both in the form the footage print and also Pen Drive by the next date fixed
It is emphasised by the Counsel for the applicants that the prosecutrix in her statement under Section 164 of Cr.P.C. has not at all nominated the applicants or made any reference to their complicity.
