The Allahabad High Court on Monday rejected the anticipatory bail application of Yogesh Kumar Tiwari, who is accused of forgery by several persons, including a retired IFFCO officer.
It is submitted by Counsel for the applicant that he has been falsely implicated in the crime, at the instance of the informant, who is a Zila Mantri of the Bharatiya Janata Party, on account of animosity.
During the hearing the petitioner counsel submitted that In 2017 there was a proposal to marry the complainant and they were in consensual relationship.
The allegations are primarily of involvement of respondents who is posted as Additional District Magistrate, Ghaziabad in the matter of diversion of oxygen cylinders.
Justice Dinesh observed – “The trial court neither speak about concurrent or consecutive. The petitioner has served 5 years under section 363, 7 years under section 366, 10 years for 376 IPC.”
