In this case, the minor rape accused had moved the Supreme Court against High Court order. He sought that he be released forthwith on bail after being presented before the JJ Board as provided by the Juvenile Justice Act's Section 12. But the Apex Court said no.
The Supreme Court dismissed a plea filed by a prosecutrix challenging bail granted to a rape accused alleging she was raped on false pretext of marriage. The bench of Chief Justice NV Ramana and Justice Surya Kant observed that the prosecutrix was already married when she came into contact with accused.
