A single-judge bench of Allahabad High Court while hearing a petition filed by Radha Kant Tripathi directed the Basic Education Council to consider the issue of appointment of husband and wife in the same District in the context of inter-district transfer.
Until further orders of the Court, operation of the March 5, 2021 order passed by the Additional Chief Secretary, UP Govt shall remain stayed. However, enquiry against the petitioner shall continue and he shall cooperate with the same, ordered the Court.
This order has been given by Justice Pankaj Bhatia on the Petition of Rakesh Vishwakarma and three others. The Court has given this order based on the instructions given in the Sunita Sharma case and Shri Krishna case.
New Delhi (ILNS): The Allahabad High Court has ruled that district administrations do not have the right to interfere in the Basic Education Council law. The court has made it clear that this is an independent law.
