The Supreme Court today issued notice in a plea filed by National commission for Women (NCW) challenging the Bombay HC judgment passed by Justice Pushpa Ganediwala, wherein she held that there must be “skin to skin contact with sexual intent” for an act to be considered sexual assault.
Earlier, the constitution bench had refused to lift the stay order by the court on making appointments and emissions under the Maratha Quota. The three-judge bench had referred the appeals to a constitution bench.
Justice Ganediwala's order saying skin-to-skin contact was necessary to be considered sexual assault under POCSO had set social media abuzz for its perceived insensitivity. Later, Chief Justice of India S.A. Bobde stayed the order as far as the POCSO provision went.
