The Delhi High Court has issued notice to the Central Adoption Resource Authority (CARA) in a petition filed by a couple, who are Overseas Citizen of India (OCI) card holders and had registered with CARA for adoption of a child in 2018.
A single-judge Delhi High Court bench of Justice Rekha Palli heard the matter through video conferencing and issued notice to the Ministry of Home Affairs and the Sub Divisional Magistrate, Dwarka, New Delhi.
According to the petitioners present legal regime created by section 7B(1), 7D, and 8(2) read with section 9 (1) of the Citizenship act violates Article 14, 21 and 25. The writ petitioners also described how the citizenship laws over dual citizenship were before the constituent assembly.
