The Centre has moved the Supreme Court seeking the recall of the Court's December 17 order which had stayed elections to seats that were reserved for the OBC quota in local bodies and renotify them as general category seats.

The Centre on Friday moved the Supreme Court seeking a review of the judgment of May 5 by the Constitution Bench which struck down Maratha reservation as envisaged by the Maharashtra Reservation for Socially and Educationally Backward Classes (SEBC) Act.
Arguments were placed before the Supreme Court today on the contentious issue of whether states should be allowed to exceed the 50 percent ceiling on reservation and on whether this issue should be referred to an 11-judge bench.
The bench, comprising Justices Arun Mishra, Indira Banerjee, Vineet Saran, M R Shah and S. Ravindra Bhat observed: “Merely because the informant and the investigating officer is the same, it cannot be said that the investigation is biased and the trial is vitiated.”

A three-judge bench of Chief Justice SA Bobde and Justices R Subhash Reddy and BR Gavai, passed the reference order today. This came while the court was hearing a batch of petitions challenging the validity of the Constitution (103rd Amendment) Act, 2019.
