The division bench of Chief Justice Dipankar Datta and Justice Girish S Kulkarni passed this order while hearing a PIL filed by Neelima Sadanand Vartak.
Gogoi had tested positive on August 25. He was discharged two months later on October 25. However, his health worsened again following which he was against admitted to the hospital on November 2.
The three-judge bench of Justices Ashok Bhushan, R. Subhash Reddy and M. R. Shah heard the case and has asked the states to file their current status report as well as compliance report. The case has been slated for next hearing on Friday.

The bench said that all aspects of the Hathras case, including security to the victim's family and witnesses, will be looked after by the Allahabad High Court.
