The Himachal Pradesh High Court has observed that a victim of a sexual offence cannot have any locus standi to approach the Court for quashing of FIR registered for the sexual assault, which she had faced.
The Court has perused a series of Judgment passed by the Supreme Court, which had held that in intermediate quantity, the rigours of the provision of Section 37 of the NDPS Act may not apply.
While granting the anticipatory bail to the Petitioner, Justice Anoop Chitkara observed: “While deciding bail Applications, the Courts should discuss evidence relevant only for determining bail.
