The Delhi High Court has quashed an First Information Report (FIR) registered against a man upon allegations of raping a woman at multiple occasions on false promise of marriage, while noting that the process of the law is being used as a tool for settling personal scores.
The Delhi High Court has opined that the offence under Section 33 of the Delhi Excise Act, 2009, which has been alleged against the petitioner, is not made out from the facts and circumstances of the instant case, and that the quantity of liquor that has been seized from the residence of the petitioner, falls within the maximum permissible limit specified under Rule 20 of the Delhi Excise Rules, 2010.
The complainant herself appeared before Delhi High Court bench and contended that they have solemnized their marriage and they are living a happy life with one another, for the reason she wants the FIR to be quashed.
