A single-judge bench of Allahabad High Court allowed the bail application of the accused seeking bail under Sections 363, 366, 504, 506, 376 IPC & Sections 3/4 of P.O.C.S.O. Act, Police Station Mitauli, District Lakhimpur Kheri, during the pendency of trial.
The Supreme Court on Friday agreed to hear on March 15, a plea filed by family members of farmers mowed down by a car belonging to Ashish Mishra, in Lakhimpur Kheri challenging bail granted to him by the Allahabad High Court. Mishra is the son of Union Minister and BJP MP Ajay Kumar Mishra.
Sessions judge Mukesh Mishra stated in the order that the investigation in Lakhim Keri violence case is still on in the incident of mowing down of farmers by a vehicle and so the court did not find any genuine reason to release the key accused on bail.
Earlier, the SC bench directed the Uttar Pradesh government to provide protection to witnesses under the Witness Protection Scheme. The bench also said that the statements of other witnesses should be recorded before the judicial magistrate under section 164 of the Code of Criminal Procedure (CrPC) and expedite the examination of digital evidence by experts.
