The Delhi lieutenant governor is bound by the advice of council of ministers in matters for which the assembly has powers. But if the L-G differs with the advcie, he can refer it to the President for a binding decision as per Clause (4) of Article 239AA. This proviso has retained powers for the Union.
Justice Satyendra Singh Chauhan, Delhi Electricity Regulatory Commission (DERC) Chairman, in a letter to the Lieutenant Governor (LG) of Delhi, has sought to extend the appointment of the Chairman till the age of 67 years or till the new incumbent joins.
The Delhi High Court on Tuesday issued notice on a plea, challenging the constitutional validity of the GNCTD Amendment Act, which has enhanced the powers of the Lt Governor in Delhi over the elected government.

Senior Advocate Geeta Luthra, appearing for the petitioner before the High Court, had submitted, “The Government of NCT of Delhi had issued a circular/order dated 9th July, 2020 restricting grant of study leave, but despite that, 11 doctors were permitted to go on study leave.
