The Supreme Court has issued notice in a plea filed against the order of the Bombay High Court which had directed to register an FIR against erring officials in a case custodial violence and subsequent registration of FIR against the then Station house officer, Anil Deshmukh.
The Court directed the State of Maharashtra to discontinue the practice of shifting mentally ill patients from institutions to Beggar Homes/ Custodial Homes on the ground that it was counterproductive to Section 104 of the Mental Healthcare Act.
The former Mumbai Police chief said the Maharashtra Government wants him to withdraw the complaint he had made against former Home Minister Anil Deshmukh. Since he isn't doing so, they are out to frame him in conspiracies, he said in his plea to the Supreme Court.
The Supreme Court on Friday issued notice and granted interim relief from arrest to a government official accused in a case of cheating and forgery registered with the MIDC, Police Station, Latur, Maharashtra.
The Petition states that despite having withdrawn the consent permitting the CBI to exercise their powers in Maharashtra, they could exercise their powers only after a constitutional court permitted.
The petition has further raised the issue indicating that whether the High Court can entertain a PIL and direct the CBI to conduct a preliminary inquiry without it being shown that there was an abuse of power of investigation.
