On the plea of former Mumbai Police Commissioner Param Bir Singh, the Bombay High Court asked why did not Parambir Singh file an FIR, how can the transfer petition be PIL, the court asked for the station diary.
Contemplating whether Singh’s plea against Deshmukh is maintainable or not, the court said that it will address the matter on two aspects - is the PIL maintainable and can the court direct investigation without an FIR.
Apart from the inquiry, Singh sought the quashing of the order transferring him from the post of Mumbai Commissioner of Police alleging it to be arbitrary and illegal.
The petition has been filed after allegations of corruption have been brought to light by former Mumbai Police Commissioner Param Bir Singh against Deshmukh.
The Constitutional bench of the Hon'ble Supreme Court told Mukul Rohatgi that the Article 226 has wide powers. The matter is quite serious. Lot of material is there which is come into public domain".
Singh said he wrote in detail to Chief Minister Thackeray on the lack of truth in media statements issued by Deshmukh and also messages sent to police officers bypassing him and the Commissioner's office.
