The Supreme Court has refused the petition of a 68-year-old retired Govt engineer Mohammed Kaleem Ahmed, who was arrested among 17 other leaders and activists of the Social Democratic Party of India and Popular Front of India by the National Investigation Agency, in connection with the Bengaluru Riots.
The plea has been filed by PFI general secretary Anis Ahmed, through Advocate A. Selvin Raja, challenging the MHA notification. The plea states that the Ministry of Home Affairs carefully attempted to achieve the object of CAA, 2019 indirectly and implement the same by mere issuance of an executive order
It is submitted that lodging the FIR is nothing but off-shoot to the protest as well as the petition filed by the applicant against his illegal detention by the police personnel of Kursi Police Station, Barabanki.
The reasons assigned by the High Court are apparently traceable back to Article 21 of the Constitution, of course without addressing the statutory embargo created by Section 43D (5) of UAPA.
The division bench of Justices Pritinker Diwaker and PK Srivastava issued notices to the central government, the State of Uttar Pradesh, Superintendent of Jail (District Jail, Mathura), and Prabal Pratap Singh (Sub-Inspector, PS Maant, Mathura - the Informant/ Complainant).
