Physical Hearing

The Supreme Court Bar Association (SCBA) on Monday wrote a letter to Chief Justice of India (CJI) Justice N. V. Ramana, requesting him to make some changes in the Standard Operating Procedure (SOP) released by the Secretary General of Supreme Court on Saturday, for resumption of physical hearing of proceedings from September 1.

The Supreme Court has released the Standard Operating Procedure (SOP) for physical hearing of proceedings, ahead of September 1, when the apex court will resume its offline hearing, albeit partially.

Chief Justice Ramana observed that the Advocates have different opinion on the issue of continuation of virtual court hearing of the cases and that the lawyers have expressed different point of view regarding the decision of the courts to revert to the physical hearing of the cases.

The Supreme Court on Monday refused to allow mentioning for an urgent hearing on a petition challenging the Uttarakhand High Court order, which has decided to resume normal judicial work through full physical mode from August 24, 2021.

The Madras High Court on Thursday disposed off a petition, urging the Court to resume physical hearings in Courts and reopening of lawyer's chambers (Ukkarapandiyan vs The Registrar, Administration and another).

The Full Court is pleased to observe that physical hearings in the District Courts in Delhi may be resumed in a restricted manner with effect from August 16 on an experimental basis, subject to further orders, based on evaluation of the situation of the pandemic in the NCT of Delhi, said Delhi High Court

He has further submitted that while window for filing of cases in the High Court may remain open but there should be no physical hearing of cases and even online hearing of cases should be done where issues regarding demolition, eviction and recovery are involved.

Entry of litigants and public into the Court premises from the very outer gate shall continue to be prohibited.
