The Punjab and Haryana High Court today dismissed a divorce petition filed by a couple for the waiver for six months period necessary for their divorce with mutual consent under Section 13-B of the Hindu Marriage Act, 1955 (The Act) citing irreconcilable differences. The marriage was not consummated and the couple is living separately from the very third day of their marriage.
The petitions, filed by IPS officers Siddharth Chattopadhyay and Mohammad Mustafa, had challenged the Punjab and Haryana High Court's order of upholding the appointment of Dinkar Gupta.
The PIL in Punjab and Haryana High Court filed by one Kartar Singh further contended that the respondent authorities on the contrary have issued a notification dated 29.09.2020, which according to the petitioner is in violation of RTE Act provisions.
The Supreme Court on Saturday allowed the applications of the Punjab and Haryana High Court and the Allahabad High Court to transfer of judicial officers/sessions court judges who are dealing with cases of prosecution of MPs or MLAs to other suitable posts.
