The Gauhati High Court disposed of a PIL seeking a direction to the authorities in the Government of Assam to ensure proper compliance and implementation of the requirement of Section 12(1)(c) of the Right of Children to Free and Compulsory Education Act, 2009.
The present PIL in Gauhati High Court has been filed Education Act (for short RTE Act) read with Rules 7 & 8 of the Assam Right to education Rules and Notifications issued to that effect.
Before addressing the issue, Madras High Court division bench find it necessary to address the locus of the petitioner. The writ petition has not been filed by the educational institution, but by the individual showing him to be the Correspondent of Little Flower Matriculation School.

The PIL has been filed by NGO Ameliorating India alleging that the act of the respondent authorities in conducting the board examinations and charging examination fee on the ground that the same is in violation of the provisions of the Right of Children to Free and Compulsory Education Act, 2009.
The Court ruled that no teacher shall be deployed for any non -educational purposes other than the decennial population census, disaster relief duties or duties relating to elections to the local authority of the State Legislatures or Parliament, as the case may be.
