A five-Judge Constitution Bench of the Supreme Court on Friday issued directions that are expected to speed up trials in cases of cheque bounce, under Section 138 of the Negotiable Instrument Act across India.
The Special Bench headed by Chief Justice S.A. Bobde, Justice Sanjay Kishan Kaul and Justice Surya Kant was hearing the PIL filed by NGO Lok Prahari through its general secretary.
The Court earlier on 27.03.2020 had extended the period of limitation prescribed under the general law or special laws whether compoundable or not with effect from 15.03.2020 till further orders. The order dated 15.03.2020 was extended from time to time.
A supreme Court bench headed by Chief Justice of India S.A. Bobde pulled up the Centre for not responding to matter concerning appointment of additional judges in high courts, which is causing pendency of cases.
The President of Supreme Court Advocates on Record Association (SCAORA) on Tuesday has written a letter to the Chief Justice of India S.A. Bobde requesting resumption of working of the Courts in a physical setting from July 2020.
