The petitioner in Madras High Court said that the OBC candidates must be eligible for 50 percent reservation as envisaged under the Tamil Nadu Backward Classes, Scheduled Castes and Scheduled Tribes Act, 1993 and as previously affirmed by the Court vide its earlier decision dated July 27, 2020.
The petition in the Supreme Court said that the impugned Act is unconstitutional and violative of Article 340 of the Constitution of India on the ground that reservation is permissible only to classes and not to a particular caste.
