The Delhi High Court has recently restrained the misuse of the name, image, voice and other attributes of persona, including the “jhakaas” catchphrase of actor Anil Kapoor for commercial gain. Acknowledging that such misuse can damage a celebrity’s right to endorsement, the Court also added that “fame for a person comes with disadvantages” and “this case shows that reputation and fame can transcend into damage”
However the defendants argued that the defendant has been using the impugned trademark ‘Goodyear’ in respect of brake oil, grease, gear oil, etc. since 1997. It was also argued that the mark was registered in 2002.
Cutis Biotech and the Serum Institute have applied for registration of trademark Covishield. However, their applications are pending in the Trademark Office
The Delhi High Court on Friday allowing relief to the Sun Pharma Laboratories Ltd. directed the BDR Pharmaceuticals International Pvt. Ltd. restricting them from using trademark LULIBET or any other mark that is phonetically, structurally or visually similar to the plaintiff’s trademark LABEBET.
