A division bench of Justices SS Shinde and NJ Jamadar had reserved Bharadwaj's bail plea for judgement on August 4 and the criminal application by 8 others on September 1.
The Supreme Court has today set aside the order of the Kerala High Court and granted bail to Kerala youth Thwaha Fasal, who had been booked under UAPA for alleged Maoist links. In another connected matter, the Supreme Court has dismissed an appeal by the National Investigation Agency (NIA) against bail granted to co-accused Allan Shuaib, a co-accused and law student in this case.
Solicitor General Tushar Mehta submitted, “I have a preliminary objection, that one person is in jail and a charge sheet has been filed against him under the UAPA. Eight persons filed for bail and a journalists’ association file a Habeas Corpus petition, which is not maintainable.
