The Allahabad High Court on Wednesday sought a reply from the Uttar Pradesh Government in four weeks on a petition challenging the legality of inclusion of Gram Panchayat Lodhan in the Municipal Corporation of Varanasi.
This order has been given by the division bench of Justice S.P. Kesharwani and Justice Ajay Bhanot on the petition of Gram Panchayat Lodhan Dist Varanasi And Another. Advocates Manish Singh and Sushma Singh argued the petition.
The petitioners said that the Gram Panchayat has been abolished on December 5, 2019 and included in the Municipal Corporation of Varanasi. This is in violation of the provisions of Article 243(q) of the Constitution.
The petitioner has been elected village head for five years under Article 243(e). He has the statutory right to complete his tenure, which cannot be deducted. This is contrary to constitutional provisions.

The Court considered the matter and sought a reply from the State Government on the petition, which will be next heard on March 22.
