Supreme Court issues notice to Land Acquisition Officer, Executive Engineer in Karnataka in case related to compensation over land acquisition

The reference Court has granted the market value of Rs. 40,000 per acre on the acquired land which was later enhanced to Rs. 3,00,000 as per the market value by the High Court of Karnataka along with all statutory benefits.

The Supreme Court on Thursday issued notice to the Special Land Acquisition Officer Malaprabha Project Dharwad 3 and the Executive Engineer M.L.B.C.C., Karnataka, over a plea seeking enhancement of compensation provided to the petitioner in lieu of his land acquired by the state for submersion in the river Malaprabha reservoir project.

The matter was listed before the Division Bench of Justice Indira Banerjee and Justice V. Ramasubramanian. After going through the facts presented by the Counsel of the petitioner, the bench issued notice to the concerned authority, returnable within six weeks.

The petitioner submitted before the Court that his land was acquired by the state on account of submersion in the river Malaprabha reservoir project by issuing notification under Section 4(1) of the Land Acquisition Act, 1894.

The Senior Civil Judge, Bailhongal, had granted him market value of Rs 40,000 per acre on the acquired land, which was later enhanced to Rs 3,00,000, as per the market value by the High Court of Karnataka, along with all statutory benefits.

The High Court of Karnataka further held that the interest on this amount shall be provided from the date of award made by the Tribunal. The petitioners, aggrieved by this very point that the interest shall be computed from the date of award, approached the apex court, claiming that the interest must be provided from the date of acquisition of the land.
