Uttarakhand High Court dismisses PIL against transfer of land for greenfield airport

The Uttarakhand High Court has dismissed a Public interest Litigation challenging the transfer of 1072 acres of land by the State Government from University in favour of the Civil Aviation Department of the State Government for construction of a greenfield airport.

The petitioner claimed that the said land is fertile, and should be used for agricultural purposes.

The Division Bench of Chief Justice Vipin Sanghi and Justice R.C. Khulbe, while considering the PIL , denounced such endeavours on the part of the petitioner.

“It is for the Government to formulate a policy as to how the development has to take place in the State. The petitioner cannot seek to obstruct such developmental activities merely on his whims and opinions as to how a particular parcel of land should be put to use,” observed the Bench.

The High Court therefore dismissed the petition, and directed the respondents to take further steps for development of the Airport in question.
