Allahabad High Court directs Mathura SSP to complete probe of theft at social worker’s house

The petition was filed in the year 2019. Now in the counter affidavit filed on September 14, 2021, a copy of the final report submitted by the court of ACJM-Ist, Mathura has been annexed.

The Allahabad High Court has directed the SSP Mathura to complete the investigation of the theft at the house of social worker Prakash Chandra Agarwal within three months.

The Division Bench of Justice Vivek Kumar Birla and Justice Shree Prakash Singh passed this order while hearing a petition filed by Agrawal.

The petition has been filed for issuing a writ of certiorari for quashing the report dated June 15, 2019 submitted by the Circle Officer, Nagar, Mathura.

The petition was filed in 2019. Now in the counter-affidavit filed on September 14, 2021, a copy of the final report submitted by the court of ACJM-Ist, Mathura has been annexed.

Along with rejoinder affidavit, the petitioner has annexed a copy of the order dated October 26, 2019 passed by the Additional Chief Judicial Magistrate, Mathura wherein he has accepted the protest petition filed by the petitioner and final report dated January 6, 2020 was rejected and the police was directed to investigate the matter again. Indisputably, the investigation is now pending after the rejection of the final report submitted by the petitioner.

In the facts and circumstances of the case, the petition is disposed of directing police authorities to conclude the said investigation fairly, impartially and expeditiously, preferably within three months from the date of production of a certified copy of the order before them, the court ordered. “It is made clear that the Court has not expressed any opinion on the merits of the case and the competent authority to act in accordance with law. Additional Government Advocate is directed to send a copy of the order to the Senior Superintendent of Police, Mathura for necessary compliance,” the order reads.
