Uttarakhand HC issues notice on PIL against irregularities committed by former directors of BTKIT

The Uttarakhand High Court on Wednesday issued notice on a PIL alleging certain irregularities committed by ex-directors of the Bipin Tripathi Kumaon Institute of Technology (BTKIT).

Even on an earlier occasion, the petitioner had filed a PIL before the High Court, wherein by order dated 21.12.2020, the High Court had directed the state government to consider the petitioner’s representation dated 30.09.2020, and to pass an appropriate order in accordance with law, within 12 weeks from the date of receipt of the copy of the said order.

However, by order dated 04.03.2021, instead of passing any order in accordance with law, the Additional Chief Secretary has merely appointed an Enquiry Officer, and has decided the representation dated 30.09.2020, without passing a final order.

“Merely appointing an Enquiry Officer does not mean that the representation has been allowed, or that appropriate steps have been taken by the State against the erring officers,”

-observed the Division Bench of Chief Justice Raghvendra Singh Chauhan and Justice Narayan Singh Dhanik.

Therefore, the  Court would like to know the outcome of the enquiry conducted by the Enquiry Officer . Moreover, in case, the enquiry has been completed in the last eight months, with regard to the steps taken by the State Government on the basis of the enquiry report.

The matter has been listed on December 13 for further hearing.
