Petition in HC against re-imposition of lockdown in Maha, sans guidelines

A Petition has been filed before the Bombay High Court challenging the re-imposition of the lockdown in several districts of Maharashtra sans guidelines to provide aid and assistance to farmers, labours, small business, etc.

The petition has been drafted by advocates Rajesh Inamdar and Shashwat Anand, and filed by advocate Kareem Pathan on behalf of petitioner Vicky Shivaji Mane. The petitioner is a social worker, appointed as Special Police Officer at Pune to volunteer and assist the police department in maintaining a law and order situation.

The petition seeks formation of guidelines for the poor farmers, needy, helpless and downtrodden persons for purpose of providing compensation, subsidies and stimulus, and ex gratia aid to these persons for immediate relief and rehabilitation, following the constitution and statutory mandate under Article 21 and the Disaster Management Act.

The petitioner has also asked the government to lay down a proper plan with policy for imposition and lifting of lockdown, along with guidelines for the succour of those in need. The state government should frame a comprehensive policy laying down proper conditions, indices and factors to be fulfilled and considered before issuance of every lockdown.

The petitioner has requested the court to consider its suggestions and issue necessary guidelines to aid the poor, needy, helpless and downtrodden persons regarding continuance of lockdown, until normalization of the pandemic situation.

The petitioner has requested the court to ask the respondent government to submit an exact action plan along with the tenure of the lockdown, and also submit the status report regarding effective implementation of scheme and provisions of the National Food Security Act 2013.
